General Terms and Conditions of Sale

Article 1 – Seller identification

Article 2 – Scope

These General Terms and Conditions of Sale govern sales of products (coffee, tea, and accessories) made through omega-coffee-2.myshopify.com between Pelmard Garry and any consumer (hereinafter referred to as “the Customer”).

Article 3 – Products and prices

The products offered are described with their essential characteristics. Prices are stated in euros, inclusive of all taxes. The seller reserves the right to change prices at any time. Products will be charged at the prices applicable when the order is confirmed.

Article 4 – Orders

The Customer places an order online through the website. The order confirmation by email constitutes acceptance of these General Terms and Conditions of Sale. The seller reserves the right to cancel any order in the event of stock or payment issues.

Article 5 – Payment

Payment is due when the order is placed. Transactions are secured through Shopify Payments. The seller does not retain any banking details.

Article 6 – Delivery

Orders are dispatched according to the times stated in the Shipping Policy. The seller cannot be held responsible for delays attributable to the carrier.

Article 7 – Right of withdrawal

Under Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of their order to exercise their right of withdrawal without giving a reason. The Customer is responsible for the cost of returning products unless otherwise agreed.

Article 8 – Statutory warranties

The Customer benefits from the statutory warranty of conformity (Articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Article 9 – Dispute resolution

In the event of a dispute, the Customer may use mediation or any other alternative dispute resolution method. The Customer may also use the online dispute resolution platform:

Article 10 – Applicable law

These General Terms and Conditions of Sale are governed by French law. Any dispute falls within the jurisdiction of the French courts.
